Implementing Indigenous Self - determination through Legislation in Canada

Abstract:
First Nations should pursue policy which implements legislation that recognizes and affirms self determination as a section 35(1) right, in accordance with UNDRIP, by creating legislation which ousts provincial law from Indian reserves, and allows and governance to operate in its own sphere if authority. To explore legislative options this policy paper compares federal legislation concerning Indigenous peoples in Canada and the United States.
